Terms of Service

1. Acceptance of terms

By accessing or using SMSProbe ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of service

SMSProbe provides SMS delivery testing across UK mobile networks using physical SIM cards. The Service allows you to verify whether your SMS messages are delivered to real handsets on EE, O2, Vodafone, and Three (and their associated MVNOs).

3. Account registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and API keys. You must notify us immediately of any unauthorised use.

4. Acceptable use

You agree not to:

• Use the Service to send spam, unsolicited messages, or illegal content
• Attempt to overload, disrupt, or reverse-engineer our infrastructure
• Share your account credentials or API keys with unauthorised parties
• Use the Service for any purpose that violates UK law
• Resell or redistribute the Service without written permission

5. Plans and billing

Free accounts are subject to monthly test limits. Paid plans are billed monthly in GBP. You may cancel at any time. Your plan remains active until the end of the billing period. We reserve the right to change pricing with 30 days' notice.

6. Test data

Messages received by our SIM cards during testing are stored temporarily to generate delivery reports. We retain test data according to your plan tier (see Privacy Policy for details). You retain ownership of your test data.

7. Availability and SLA

We aim for 99.7% platform uptime but do not guarantee uninterrupted service. Network availability depends on the UK mobile operators and is outside our control. We are not liable for delivery failures caused by third-party networks.

8. API usage

API access is available on Pro and Team plans. You must authenticate all API requests with a valid bearer token. Rate limits apply and vary by plan. Abuse of the API may result in temporary or permanent suspension.

9. Limitation of liability

SMSProbe is provided "as is". We are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you breach these terms. You may delete your account at any time from the account settings page. Upon termination, your data will be deleted within 30 days.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use after changes constitutes acceptance.
